In the State of Hawaii, offenses against public order are charged under Hawaii Revised Statutes (HRS) Section 711. Offenses against public order are mostly classified as Class B and C felonies or misdemeanors. The type of classification determines the authorized sentence.
If found guilty of a felony, the Hawaii paroling authority will determine the minimum amount of time served and eligibility for parole. This will be determined at a separate hearing after trial. There are three classes of felonies:
- Class B felonies are punishable with up to 10 years imprisonment
- Class C felonies are punishable with up to 5 years imprisonment
If found guilty of a misdemeanor, the judge will determine the sentence. There are two types of misdemeanors:
- Misdemeanors are punishable with up to one year imprisonment and fine of $2,000
- Petty misdemeanors are punishable with up to 30 days imprisonment and a fine of $1,000

- Sexual assault of an animal (second or subsequent offense)
- Sexual assault of an animal in the presence of a minor
- Subjecting a minor to sexual contact with an animal

- Riot
- Aggravated harassment by stalking
- Cruelty to animals in the first degree
- Causing injury or death to a service animal or law enforcement animal
- Sexual assault of an animal (first offense)
- Cruelty to animals by fighting dogs in the second degree
- Violation of privacy in the first degree
- Interference with the operator of a public transit vehicle
MISDEMEANORS
- Failure to disperse
- Unlawful assembly
- Harassment by stalking
- Harassment by impersonation
- Abuse of a corpse
- Cruelty to animals in the second degree
- Intentional interference with the use of a service animal or law enforcement animal
- Pet animal or equine animal desertion, recklessly causing the death of or substantial bodily injury to the pet animal or equine animal
- Cruelty to animals by trapping
- Violation of privacy in the second degree
PETTY MISDEMEANORS
- Disorderly conduct
- Obstructing any highway or public passage
- Harassment
- Pet animal or equine animal desertion
