What Are Offenses Against Property Rights?

 

In the State of Hawaii, offenses against property rights are charged under Hawaii Revised Statutes (HRS) Section 708. Offenses against property rights are classified as felonies or misdemeanors. The type of classification determines the authorized sentence.
If found guilty of a felony, the Hawaii paroling authority will determine the minimum amount of time served and eligibility for parole. This will be determined at a separate hearing after trial. There are three classes of felonies:
 

  • Class A felonies are punishable with up to 20 years imprisonment
  •  

  • Class B felonies are punishable with up to 10 years imprisonment
  •  

  • Class C felonies are punishable with up to 5 years imprisonment

 
If found guilty of a misdemeanor, the judge will determine the sentence. There are two types of misdemeanors:
 

  • Misdemeanors are punishable with up to one year imprisonment and fine of $2,000
  •  

  • Petty misdemeanors are punishable with up to 30 days imprisonment and a fine of $1,000

  • Burglary of a dwelling during an emergency period
  • Identity theft in the first degree
  • Robbery in the first degree
  • Computer fraud in the first degree
  • Computer damage in the first degree
  • Unauthorized computer access in the first degree
  • Arson in the first degree

 
CLASS B FELONIES
 

  • Burglary of a building during an emergency period
  • Burglary in the first degree
  • Unauthorized entry in a dwelling in the first degree
  • Criminal property damage in the first degree
  • Theft in the first degree
  • Telemarketing fraud
  • Identity theft in the second degree
  • Robbery in the second degree
  • Forgery in the first degree
  • Computer fraud in the second degree
  • Computer damage in the second degree
  • Unauthorized computer access in the second degree
  • Fraudulent encoding of a credit card
  • Arson in the second degree is a class B felony
  • Unlicensed contractor fraud in the first degree
  • Money laundering of $10,000 or more

 
CLASS C FELONIES
 

  • Burglary in the second degree
  • Unauthorized entry in a dwelling in the second degree
  • Criminal property damage in the second degree
  • Theft in the second degree
  • Theft of livestock
  • Theft of copper
  • Unauthorized control of a propelled vehicle in the first degree
  • Unauthorized entry into motor vehicle in the first degree
  • Identity theft in the third degree
  • Unauthorized possession of confidential personal information
  • Forgery in the second degree
  • Criminal possession of a forgery device
  • False labeling of Hawaii-grown coffee
  • Trademark counterfeiting
  • Computer fraud in the third degree
  • Computer damage in the third degree
  • Unauthorized computer access in the third degree
  • Fraudulent use of a credit card
  • Credit card theft or forgery
  • Arson in the third degree
  • Unlicensed contractor fraud in the second degree
  • Money laundering of less than $10,000

 
MISDEMEANORS
 

  • Possession of burglar’s tools
  • Criminal trespass in the first degree
  • Entry upon the premises of a facility utilized as a sex, child, or spouse abuse shelter
  • Criminal property damage in the third degree
  • Aggravated criminal property damage
  • Failure to control widely dangerous means
  • Criminal tampering in the first degree
  • Criminal littering
  • Theft in the third degree
  • Theft of beer keg
  • Unauthorized control of a propelled vehicle in the second degree
  • Unauthorized entry into a motor vehicle in the second degree
  • Failure to return a rental motor vehicle
  • Unlawful possession
  • Theft of utility services in the second degree
  • Forgery in the third degree
  • Obtaining a signature by deception
  • Negotiating a worthless negotiable instrument
  • Deceptive business practices
  • False advertising
  • Falsifying business records
  • Defrauding secured creditors
  • Commercial bribery
  • Making a false statement to procure issuance of a credit card
  • Arson in the fourth degree
  • Habitual unlicensed contracting activity

 
PETTY MISDEMEANORS
 

  • Criminal trespass in the second degree
  • Criminal trespass onto public parks and recreational grounds
  • Criminal trespass onto state lands
  • Criminal property damage in the fourth degree
  • Theft in the fourth degree
  • Failure to return leased or rented personal property
